Introduction
These Terms and Conditions of Use ("Agreement") are a legally binding agreement between "us" or "we" ("Nevermiss") and the entity or person ("you", "your", or "user") that is or will be using our FiveM enhancement software ("Service" or "Services"). Your access or use of https://nevermiss.cc (the "Website") and our Services indicates that you agree to be bound by this Agreement in its entirety.
Acceptance of Terms
By using our Services, you are agreeing to these terms and conditions. Your continued use of the Services signifies that you understand, acknowledge, and accept all provisions contained herein. If you do not agree with any part of these terms, you must discontinue using our Services.
Modifications to the Agreement
We reserve the right to change or modify this Agreement at any time. We will endeavor to provide notice of material changes on the Website. Unless otherwise specified, any modifications to this Agreement will become effective on the date they are posted. Your continued use of our Services after the modifications have been posted constitutes your acceptance of the revised Agreement.
Description of the Services
Nevermiss provides a premium FiveM enhancement software designed for competitive PvP gameplay. Our software offers advanced features including aimbot, ESP, and other gameplay enhancements. We do not guarantee that any feature or function will operate without error or disruption.
Nevermiss Requirements
1. We only support Windows 10 (20H2, 21H1, 21H2, 22H2) and Windows 11 (22H2, 23H2, 24H2), and if you use any other operating system, we cannot guarantee its functionality. 2. We don't guarantee our product to work on virtual machines such as Shadow, VirtualBox, VMware or virtual private servers. 3. Our product requires an active Internet connection during the whole usage.
Subscription Plans
1. Monthly Plan ($50/month): Full access to all Nevermiss features with monthly billing. 2. 3 Months Plan ($100): Save money with our quarterly subscription option. 3. Lifetime Plan ($150): One-time payment for permanent access to Nevermiss.
Licenses and Subscriptions
1. Subscription Plans: We offer Monthly, 3 Months, and Lifetime subscriptions. These are classified as Products under these Terms and Conditions. 2. License Requirement: You must purchase a subscription to access our software and utilize any part of our product. 3. Payment: All payments are processed through our Discord server. Contact us via Discord to complete your purchase. 4. Additional Terms: Specific payment terms and other relevant details will be provided during the purchase process on Discord.
No Warranties and No Liability
1. No Warranties: We provide our Services on an "as is" and "as available" basis, without warranties of any kind. 2. No Responsibility for Bans: We are not responsible for any banishment, suspension, or penalty you might incur in any game resulting from the use of our Services. 3. Functionality Limitations: Some functions may not work correctly, and we are not obligated to fix or modify them. 4. No Refund or Compensation: If not specified, we do not offer compensation or refunds of any kind.
License Deactivation
We reserve the right to terminate your license and your access to our Website or Services at our sole discretion, without notice and without specifying a reason.
Eligibility and Prohibited Use
1. Association with Game Dev/Anticheat Companies: You are not allowed to use our Services if you are associated with any game development or anticheat company. 2. Reverse Engineering: You may not attempt to debug, decompile, disassemble, or reverse engineer our products. 3. Sharing/Reselling: You may not share or resell our products under any circumstances. 4. Attacks Prohibited: You may not attempt any type of attack against our site or servers. 5. Payment Method Authorization: You can only use the payment method for which you have the proper authority. 6. Disputes and Chargebacks: Disputing a payment will permanently disable your account. 7. Use of Videos/Images: If you use videos/images of our Services, they must include our logo. 8. Acceptance or Prohibition: If you do not agree to these terms, you are prohibited from using our Services.
User Responsibilities
1. Local Law Compliance: By using our Services, you take responsibility for following any local laws that might apply. 2. Account Security: You are responsible for maintaining the confidentiality of your account. 3. Respect of Community and Data: You agree not to disclose sensitive information obtained in our community. 4. Prohibited Behavior: You may not engage in malicious behavior or harassment.
Limitations of Liability
1. Indirect Damages: Nevermiss shall not be liable for any indirect, consequential, incidental, punitive, or special damages. 2. Scope of Liability: The total liability of Nevermiss shall not exceed the amount you paid to us. 3. Compatibility and Risks: You acknowledge that by using our Services, you risk potential penalties in your game(s).
Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Lithuania. Any disputes arising from these terms shall be resolved in the courts located in Vilnius, Lithuania.
Intellectual Property & Copyright
1. Ownership: All rights, titles, and interests in and to the Services are owned by or licensed to Nevermiss. 2. Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services. 3. Trademarks: Our trademarks and trade dress may not be used without our prior written consent.
Waiver
No waiver of any provision of this Agreement shall be binding unless it is in writing and signed by an authorized representative of Nevermiss.
Entire Agreement
This Agreement constitutes the entire understanding between you and Nevermiss regarding the subject matter herein.
